Terms of Use

These Terms of Use (“Terms”) form the agreement between you and TritonApps, an indie studio based in the Republic of Ireland (“we”, “us”), for your use of the TritonFire mobile app for iOS and Android and the related website at tritonfire.tritonapps.com (together, the “Service”). By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Acceptance

By using the Service you accept these Terms, our Privacy Policy, and our End-User Licence Agreement. Together they form the complete agreement. TritonFire does not require a user account; your presets, scenes, and settings are stored locally on your device.

2. Licence & eligibility

We grant you a limited, non-exclusive, non-transferable, revocable licence to install and use TritonFire on devices you own or control, for your personal purposes, subject to these Terms and the EULA.

You must be at least 13 years old to agree to these Terms on your own behalf. If GDPR Article 8 applies to you, the minimum age may be higher (16 in many EU member states) unless a parent or guardian has consented on your behalf; younger children may use the App under a parent’s or guardian’s account and supervision. The Service is not available to people on applicable sanctions lists or in jurisdictions where it would be unlawful to provide it.

4. Photosensitivity notice

TritonFire displays bright, fast-moving, and flashing visual effects. A small percentage of people may experience discomfort or seizures when exposed to flashing lights or patterns, even with no history of photosensitive epilepsy. The App includes a low-flash mode and calmer alternative presets; if you or anyone watching has a history of photosensitivity, enable low-flash mode before playing and stop using the App immediately if you experience dizziness, altered vision, eye or muscle twitches, loss of awareness, or disorientation.

5. Purchase

TritonFire is a paid app sold as a one-time purchase through the Apple App Store and Google Play. Payment is charged to your Apple Account or Google Account at confirmation of purchase. Your purchase includes every feature of the App — there are no subscriptions, no in-app purchases, and no ads. The purchase is tied to your store account and may be installed on devices associated with that account under the store’s usage rules, including family-sharing arrangements where the store supports them.

All payments are processed by Apple or Google; we do not receive or store your payment details. Refunds, where available, are handled in accordance with the policies of the App Store or Google Play.

6. Intellectual property

The Service, including the TritonFire name, marks, user-interface design, artwork, effect presets, and code, belongs to TritonApps or our licensors. Except for the licence granted above, no rights are granted to you. You may not use our names or marks without our prior written permission.

7. Your content & exports

You retain ownership of the custom presets, scenes, and exported files that you create with TritonFire, and of any video recordings you make of your scenes. Because this data is stored locally on your device, you are responsible for backing it up; we have no access to it and cannot recover it for you. You are free to share recordings of your TritonFire scenes, including for commercial purposes such as monetised videos.

8. Disclaimers

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, that it will perform to any particular frame rate or fidelity on your device, or that defects will be corrected.

Nothing in these Terms limits or excludes any non-waivable consumer rights you have under the law that applies to you (including the EU Consumer Rights Directive, where applicable).

9. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of or in connection with the Service is capped at the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) EUR 50. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profit, revenue, data, or goodwill. This clause does not limit liability that cannot be limited under applicable law (for example, liability for death, personal injury caused by our negligence, or fraud).

10. Indemnification

You agree to indemnify TritonApps against third-party claims arising from your misuse of the Service or your breach of these Terms, except to the extent the claim arises from our wrongdoing.

11. Termination

You may stop using the Service and uninstall the app at any time; deleting the app removes your locally stored presets, scenes, and settings. We may suspend or terminate your licence if you breach these Terms, if continuing to provide the Service to you would expose us to legal risk, or if we discontinue the Service. Where we terminate without cause, we will give reasonable notice. Your purchase remains governed by the App Store or Google Play that processed it.

12. Changes to the app & terms

We may update, change, or discontinue features of the Service, and we may update these Terms. If a change to these Terms is material, we will give you notice in-app before it takes effect, and update the effective date above. If you do not agree to the change, you may stop using the Service before the change takes effect.

13. Governing law & venue

These Terms are governed by the laws of the Republic of Ireland, without regard to its conflict-of-laws rules. Subject to any non-waivable rights you have under your local consumer law, the courts of Ireland have exclusive jurisdiction over any dispute arising out of or in connection with these Terms. If you have a dispute with us, please contact support@tritonapps.com first and we will try to resolve it informally.
