These Terms of Use (“Terms”) form the agreement between you and TritonApps (“we”, “us”) for your use of the Piece of Cake mobile app and the related website at pieceofcake.tritonapps.com (together, the “Service”). By creating an account, signing in, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Acceptance
By using the Service you accept these Terms, our Privacy Policy, our End-User Licence Agreement, and (if you subscribe) our Subscription Terms. Together they form the complete agreement.
2. Eligibility
You must be at least 13 years old to use the Service. If GDPR Article 8 applies to you, the minimum age may be higher (16 in many EU member states) unless a parent or guardian has consented on your behalf. The Service is not available to people on applicable sanctions lists or in jurisdictions where it would be unlawful to provide it.
3. Account responsibility
You are responsible for keeping your sign-in credentials secret and for activity on your account. One human, one account. If you think your account has been used without your permission, contact support@tritonapps.com right away.
4. Acceptable use
While using the Service you agree not to:
- harass, threaten, or abuse other players;
- impersonate another person or misrepresent your identity;
- automate, script, or otherwise game the gameplay engine, including reverse-engineering the protocol or attempting to see other players’ hands;
- use the Service to send spam or unlawful content;
- circumvent our security or rate-limiting measures; or
- use the Service in violation of any law that applies to you.
5. Content you provide
You are responsible for the display name, avatar choice, and table names you choose. You agree not to use content that infringes another’s rights, is obscene, hateful, or otherwise inappropriate. We may remove or change content that breaches these Terms and may suspend the account that posted it.
6. Intellectual property
The Service, including the Piece of Cake name, marks, game artwork, sound design, and code, belongs to TritonApps or our licensors. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes, subject to these Terms. No other rights are granted.
7. Subscription overview
The Service offers an optional auto-renewing subscription (“Pro”) that unlocks additional features. Auto-renewal, billing, free-trial, cancellation, and refund details are set out in the Subscription Terms, which are incorporated into these Terms by reference.
8. Termination
You may delete your account at any time — see Account deletion. We may suspend or terminate your account if you breach these Terms, if continuing to provide the Service to you would expose us to legal risk, or if we discontinue the Service. Where we terminate without cause, we will give reasonable notice.
9. Disclaimers
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that defects will be corrected.
Nothing in these Terms limits or excludes any non-waivable consumer rights you have under the law that applies to you (including the EU Consumer Rights Directive, where applicable).
10. Limitation of liability
To the maximum extent permitted by law, our total liability to you for any claim arising out of or in connection with the Service is capped at the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) EUR 50. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profit, revenue, data, or goodwill. This clause does not limit liability that cannot be limited under applicable law (for example, liability for death, personal injury caused by our negligence, or fraud).
11. Indemnification
You agree to indemnify TritonApps against third-party claims arising from your misuse of the Service or breach of these Terms, except to the extent the claim arises from our wrongdoing.
12. Governing law & venue
These Terms are governed by the laws of the Republic of Ireland, without regard to its conflict-of-laws rules. Subject to any non-waivable rights you have under your local consumer law, the courts of Ireland have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
13. Dispute resolution
If you have a dispute with us, please contact support@tritonapps.com first. We will try to resolve it informally within 30 days. If we cannot, either party may pursue the dispute in the courts identified above.
14. Changes
We may update these Terms. If a change is material, we will give you notice in-app or by email before it takes effect, and update the effective date above. If you do not agree to the change, you may stop using the Service and delete your account before the change takes effect.
